Terms of Service

Rules and guidelines for using MeUp

Welcome to MeUp! These Terms of Service ("Terms") govern your access to and use of the MeUp mobile application and related services (collectively, the "Service"). By using MeUp, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using MeUp, you agree to be bound by these Terms and our Privacy Policy. If you are using MeUp on behalf of an organization, you are agreeing to these Terms on behalf of that organization.

2. Eligibility

You must meet the following requirements to use MeUp:

  • Be at least 13 years old (or 16 in the European Economic Area)
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable laws
  • Not have been previously banned from MeUp
  • Provide accurate and truthful registration information

If you are under 18, you confirm that you have your parent or guardian's permission to use MeUp.

3. Account Registration and Security

3.1 Account Creation

To use MeUp, you must create an account by providing:

  • Valid email address
  • Username (unique and not impersonating others)
  • Password (secure and confidential)
  • Optional profile information

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Using a strong, unique password

3.3 Account Accuracy

You agree to:

  • Provide accurate, current, and complete information
  • Update your information to keep it accurate
  • Not impersonate others or create fake accounts
  • Not create multiple accounts for abusive purposes

4. User Content

4.1 Your Content

"User Content" means any content you post, upload, or share on MeUp, including:

  • Events (names, descriptions, photos, GIFs, locations, dates)
  • Comments and messages
  • Profile information (bio, photos)
  • Group information and content

4.2 Content Ownership

You retain ownership of your User Content. However, by posting content on MeUp, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content for the purpose of operating and providing the Service.

4.3 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate these Terms
  • Your User Content does not infringe third-party rights
  • Your User Content complies with applicable laws

4.4 Content Moderation

We reserve the right, but are not obligated, to:

  • Monitor and review User Content
  • Remove or modify User Content that violates these Terms
  • Suspend or terminate accounts that violate these Terms
  • Report illegal content to authorities

5. Prohibited Conduct

You agree not to:

5.1 Illegal Activities

  • Violate any local, state, national, or international law
  • Engage in or promote illegal activities
  • Facilitate the sale of illegal goods or services

5.2 Harmful Content

  • Post content that is defamatory, obscene, or offensive
  • Share sexually explicit content or nudity
  • Post violent or graphic content
  • Promote self-harm or suicide
  • Share content that promotes or glorifies violence

5.3 Harassment and Abuse

  • Harass, bully, intimidate, or threaten others
  • Engage in hate speech or discrimination
  • Stalk or invade others' privacy
  • Impersonate others or create fake accounts

5.4 Spam and Manipulation

  • Send spam, unsolicited messages, or advertisements
  • Manipulate engagement (fake likes, follows, comments)
  • Use bots or automated tools without permission
  • Scrape or collect user data without authorization

5.5 Security Violations

  • Attempt to access others' accounts
  • Bypass security features or access controls
  • Introduce viruses, malware, or harmful code
  • Reverse engineer or decompile the app

5.6 Intellectual Property

  • Infringe copyrights, trademarks, or other IP rights
  • Post content you don't have rights to
  • Use MeUp's branding without permission

6. Events and Groups

6.1 Event Creation

When creating events, you agree to:

  • Provide accurate information about the event
  • Not create events for illegal activities
  • Respect location owners' rules and regulations
  • Update or cancel events if plans change
  • Not use events for commercial purposes without permission

6.2 Event Attendance

We are not responsible for:

  • The safety or legality of events created by users
  • Interactions between users at events
  • Damages or injuries at events
  • Cancellations or changes to events

You attend events at your own risk.

6.3 Groups

Group owners are responsible for:

  • Managing group membership
  • Ensuring group content complies with these Terms
  • Moderating group activities

7. Intellectual Property Rights

7.1 MeUp's Rights

MeUp and its content (excluding User Content) are protected by copyright, trademark, and other intellectual property laws. This includes:

  • The MeUp app and software
  • MeUp's name, logo, and branding
  • The design and functionality of the Service
  • Documentation and materials

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use MeUp for personal, non-commercial purposes. This license does not include:

  • Resale or commercial use
  • Collecting or using data without permission
  • Derivative works based on MeUp
  • Using MeUp's branding or content

7.3 Copyright Infringement

If you believe content on MeUp infringes your copyright, contact us at copyright@meup.app with:

  • Description of the copyrighted work
  • Location of infringing content
  • Your contact information
  • Statement of good faith belief
  • Statement of accuracy under penalty of perjury
  • Your electronic or physical signature

8. Third-Party Services

MeUp integrates with third-party services:

  • Firebase: Authentication, database, storage, notifications
  • Apple MapKit: Location search and maps
  • Giphy: GIF search and integration

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Termination

9.1 By You

You may delete your account at any time through the app settings. Upon deletion:

  • Your account and profile will be removed
  • Your events and content will be deleted
  • Your messages will be deleted
  • Some data may be retained as required by law

9.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in prohibited conduct
  • Your account has been inactive for an extended period
  • We are required to do so by law
  • Continuing your account creates risk or legal exposure

Termination may be immediate without prior notice for serious violations.

9.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and content
  • Sections of these Terms that should survive will remain in effect

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Merchantability, fitness for a particular purpose, non-infringement
  • Accuracy, completeness, or reliability of content
  • Uninterrupted, secure, or error-free service
  • Quality or safety of events or user interactions
  • Results from using the Service

You use the Service at your own risk. We do not warrant that the Service will meet your requirements or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Business interruption or loss of opportunities
  • Damages arising from your use or inability to use the Service
  • User Content or conduct of other users
  • Unauthorized access to your account or data
  • Events organized through the Service

Our total liability to you for all claims shall not exceed the greater of $100 USD or the amount you paid us in the past 12 months (if any).

Some jurisdictions do not allow limitations on liability, so these may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless MeUp and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of others
  • Your violation of applicable laws

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the jurisdiction where MeUp operates, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing a claim, you agree to contact us at legal@meup.app and attempt to resolve the dispute informally.

13.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration, except where prohibited by law. You waive your right to a jury trial or to participate in a class action.

13.4 Exceptions

The following may be resolved in court:

  • Intellectual property disputes
  • Claims of unauthorized access or theft
  • Injunctive relief

14. General Provisions

14.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and MeUp regarding the Service.

14.2 Modifications

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app. Your continued use after changes become effective constitutes acceptance.

14.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.5 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

14.6 No Agency

No agency, partnership, joint venture, or employment relationship is created by these Terms.

16. Additional Terms for iOS

If you access MeUp through the Apple App Store, you acknowledge that:

  • These Terms are between you and MeUp, not Apple
  • Apple has no obligation to provide support for MeUp
  • Apple is not responsible for any claims related to MeUp
  • You will comply with Apple's App Store Terms of Service
  • Apple and its subsidiaries are third-party beneficiaries of these Terms

By using MeUp, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
